General terms and conditions for the temporary use of the online platform ‘Playerdash.app”

The following terms of contract apply to conclusions of contract regarding the web application Playerdash.app between L&A Video Consulting GmbH, Chamissostrasse 1, 68177 Mannheim (referred in the following passages as “LA“) and their contract partners (referred in the following passages as “customers“).
§1 Object of agreement
The object of contract is the temporary usage of the web platform my.playerdash.app against payment.
The functionality and scope of services of the platform are as listed on the website Playerdash.app, except for individual agreements. The statements are a specification of services and no guarantee. A guarantee is only granted if it’s specifically labelled as one.
The platform will be developed continuously and potential errors will corrected. Thus, there might be possible changes made to the platform and the functions could differ in the future from the original functions known at the moment of inception of treaty.
§2 Contract period
The usage starts as soon as the access has been granted. The contract period is defined in the bill.
Provisional terminations by the customer are not possible. Termination for good cause shall remain unaffected by this. Good cause shall be deemed to exist for the lessor in particular if
a) the customer substantially infringes „LA“’ s rights by leaving the rented item to a third party without authorisation
or
b) the customer allows more than one person to use a user account
or
§3 Compensation
The customer shall pay the agreed compensation (lease) for the use of the platform and, if applicable, the extensions.
The compensation shall be paid by the customer within 14 days after receipt of the invoice. Payment instructions can be found on the invoice.
c) the customer uses data, images or content with the software for which the customer does not hold the necessary rights of use.
$4 Access
The platform can be accessed online at the URL my.playerdash.app.
The use of the Platform is access restricted.
The Customer will receive access for a user account to the Platform no later than the Invoice Date.
When purchasing via the website, the customer will receive access for a team account to the platform no later than 3 days after purchase.
$5 Rights of use
If more than one user account has been purchased for the team environment, the customer may independently create further user accounts and invite and delete users in his team environment.
The number of permitted user accounts is specified in the contract.
The platform may not be used by several persons via one user account.

Allgemeine Geschäftsbedingungen für die zeitlich befristete Nutzung der Online-Plattform „Playerdash.app“
Die nachstehenden Vertragsbedingungen gelten für Vertragsabschlüsse über die Webapplikation Playerdash.app zwischen der L&A Video Consulting GmbH, Chamissostrasse 1, 68167 Mannheim (im Folgenden „LA“ genannt) und ihrer Vertragspartner (im Folgenden „Kunde“ genannt).

$2 Laufzeit
a) der Kunde die Rechte von LA dadurch in erheblichem Maße verletzt, dass er die Mietsache unbefugt einem Dritten überlässt
ODER
b) der Kunde mehr als eine Person einen Nutzeraccount nutzen lässt
ODER
c) der Kunde Daten, Bilder oder Inhalte mit der Software nutzt, für die er nicht die erforderlichen Nutzungsrechte hält.
